Resource consent required on building eaves where they intrude the boundary setback
Under the current Waitaki District Plan, no part of a building including the eaves can intrude onto the boundary setback without resource consent.
Standard eaves are 600mm and the effects of intrusion into the setback are in most cases less than minor. However,
In cases where the standard eave is specified (i.e. at 600mm) and the eave(s) intrude on a required setback, resource consent will be required and affected parties’ approval will not be required.
Planning will process such consents under the ‘quick templates’ non-notified track.
The $500 deposit will be payable, but Planning will aim to process the application for less than this so that the applicant will get a refund.
In cases where the eaves specified are greater than 600mm and intrude on a required setback, resource consent will be required and will require affected parties’ approval to be provided.
Planning will also process these consents under the ‘quick templates’ non-notified track, however the amount of refund is likely to be less.
(It should be noted, where consent is required for other matters, then the above will not apply.)
Planning Manager, David Campbell explained, “There has been a practice at Waitaki District Council of allowing eaves to intrude on the setbacks required by the site development standards in the Residential, Residential 1 and Township zones without requiring resource consent. Therefore, as part of the next District Plan review, if the intention is that intrusion of eaves into setbacks are not an issue in the District, then an exception to be included in either (or both) relevant definitions and the exceptions to the setback site development standard in the zone rules.”
